ေအေအပီပီအေနျဖင့္ က်န္းမာေရးအေျခအေန ဆိုးရြားေနသည့္ ကိုေနမ်ိဳးဇင္အား ေထာင္ျပင္ပ ေဆးရုံတြင္ သင့္ေတာ္လံုေလာက္သည့္ ေဆးကုသခြင့္ေပးပါရန္ ဦးသိန္းစိန္အစိုးရအား အေလးအနက္ တိုက္တြန္းလိုက္ပါသည္။ ဗိုလ္ႀကီးေဟာင္းတစ္ဦးျဖစ္သူ ကိုေနမ်ိဳးဇင္သည္ ေသြးအကူအညီေပးေရးအပါအဝင္ ပရဟိတလုပ္ငန္းမ်ား လုပ္ေဆာင္ရာမွ အီလက္ထေရာနစ္ အက္ဥပေဒျဖင့္ တရားစြဲဆိုခံရကာ မၾကာေသးခင္ က ေထာင္ဒဏ္ (၁၀) ႏွစ္ခ်မွတ္ခံခဲ့ရပါသည္။ သူသည္ စတင္ဖမ္းဆီးခံခဲ့ရသည့္ ေမလ၊ ၂၀၁၁ ခုႏွစ္ မွ စတင္၍ က်န္းမာေရးအေျခအေန ဆိုးရြားလာပါသည္။

ကုိေနမ်ိဳးဇင္အေနျဖင့္ စတင္ဖမ္းဆီးခံရစဥ္က က်န္းမာေရးေကာင္းမြန္ခဲ့ေသာ္လည္း ေထာင္တြင္း ေဆးဝါးကုသမႈမလံုေလာက္ျခင္း၊ ျပင္ပတြင္လုိအပ္သလုိေဆးကုသခြင့္အား အႀကိမ္ႀကိ္မ္ျငင္းဆန္ခံေနရျခင္း တို႔ေၾကာင့္ လမ္းမေလွ်ာက္ႏုိင္ရာမွ ေအာက္ပိုင္း ခ်ိနဲ႔သြားႏိုင္သည့္ အေနအထားသို႔ ေရာက္ရွိေနပါသည္။ လမ္းေကာင္းစြာ မေလွ်ာက္ႏုိင္သည့္အတြက္ ၄င္းအေနျဖင့္ မိသားစုမွေထာင္ဝင္စာလာေတြ႔သည္ကို လက္ခံေတြဆံုႏိုင္ျခင္းမရွိခဲ့ပါ။ ကိုေနမ်ိဳးဇင္၏ ျဖစ္ရပ္သည္ မတရားဖမ္းဆီးေထာင္ခ်ခံရသည့္အျပင္ ေဆးဝါးကုသခြင့္၊ ေထာင္ဝင္စာေတြ႕ဆံုခြင့္စသည္ျဖင့္ ႏုိင္ငံသားတဦး၊ အက်ဥ္းသားတစ္ဦး၏ အေျခခံ အခြင့္အေရးမ်ားကို အစုလိုက္အၿပံဳလုိက္ ခ်ိဳးေဖါက္ခံေနရျခင္း၏ ျပယုဂ္တခုပင္ ျဖစ္ပါသည္။ ေထာင္ဥပေဒအရ ကုိေနမ်ိဳးဇင္ ရသင့္ရထုိက္သည့္ က်န္းမာေရးေစာင့္ေရွာက္မႈျဖစ္သည့္ ေထာင္ျပင္ပေဆးရုံတြင္ သင့္ေတာ္ လံုေလာက္စြာ ေဆးကုသခြင့္အား သက္ဆုိင္ရာ ေထာင္အာဏာပိုင္မ်ားမွ ခြင့္ျပဳေပးပါရန္ ေအေအပီပီ အေနျဖင့္ေတာင္းဆိုလိုက္ရပါသည္။
ကိုေနမ်ိဳးဇင္သည္ စစ္ေၾကာေရးကာလတြင္လည္း ရုပ္ပိုင္းစိတ္ပိုင္း ႏွိပ္စက္ခံခဲ့ရၿပီး ယခုအခ်ိန္တြင္ ေခ်ာ္လဲသည့္ဒဏ္ေၾကာင့္ ခါးရုိးပဲ့ကာ လမ္းမေလွ်ာက္ႏိုင္ မရပ္ႏိုင္ ျဖစ္ေနပါသည္။

ကုိေနမ်ိဳးဇင္အား ေထာင္ေဆးရုံတြင္ ဓါတ္မွန္ရုိက္ရာတြင္ ခါးတြင္ဒါဏ္ရာ ရေနေၾကာင္းကို သိရွိရသည့္အတြက္ ေထာင္ဆရာ၀န္မွ ျပင္ပေဆးရုံတြင္ ေဆးဝါးကုသရန္ လုိအပ္ေၾကာင္း ေထာက္ခံခ်က္ေပးခဲ့ေသာ္လည္း ေထာင္အာဏာပုိင္မ်ားမွ ျပင္ပေဆးရံုတြင္ေဆးကုသခြင့္ျပဳရန္ အႀကိမ္ႀကိမ္ျငင္းပယ္ေနျခင္းျဖစ္ပါသည္။

ကိုေနမ်ိဴးဇင္အား ယခုလုိ လုိအပ္သည့္ေဆးဝါးကုသေပးရန္ အခ်ိန္ဆြဲျငင္းပယ္ေနမႈသည္ ဦးသိန္းစိန္အစုိးရမွ က်န္းမာေရးမေကာင္းေသာ အက်ဥ္းသားမ်ားကို လႊတ္ေပးသည္ဆုိသည့္ ေၾကညာခ်က္ႏွင့္ ခ်ိန္ဆၾကည့္လွ်င္ အေျပာႏွင့္အလုပ္ လံုးဝကိုက္ညီျခင္းမရွိေၾကာင္း ေတြ႔ရွိရပါသည္။

လက္ရွိအေျခအေနတြင္ ေထာင္အသီးသီးရွိ ႏုိင္ငံေရးအက်ဥ္းသား ၁၂၂ ဦးသည္ က်န္းမာေရး အေျခအေနဆိုးရြားေနၿပီး လံုေလာက္သည့္ ေဆးကုသခြင့္ မရရွိၾကပါ။ ဥပမာအားျဖင့္ ေထာင္ဒဏ္ ၉ ႏွစ္ခြဲ က်ခံေနရေသာ ဗမာႏုိင္ငံလံုးဆိုင္ရာ ေက်ာင္းသားသမဂၢအဖြဲ႕ဝင္ မဟန္နီဦးသည္ အစာအိမ္ေရာဂါ ခံစားေနရကာ ေက်ာင္းသားေခါင္းေဆာင္ ကိုမင္းကိုႏုိင္သည္လည္း ေသြးတိုးေရာဂါ ႏွင့္ ႏွလံုးခုန္ျမန္သည့္ ေရာဂါ ေဝဒနာကို ခံစားေနရပါသည္။
ေအေအပီပီ၏ စာရင္းျပဳစုထားျခင္းမ်ားအရ ႏွိပ္စက္ညွဥ္းပမ္းမႈဒဏ္ ႏွင့္ က်န္းမာေရး ေစာင့္ေရွာက္မႈ မျပည့္စံုမႈတုိ႔ေၾကာင့္ ႏိုင္ငံေရးအက်ဥ္းသား အနည္းဆံုး ၁၄၆ ဦး သည္ အက်ဥ္းေထာင္မ်ားအတြင္းတြင္ ေသဆံုးခဲ့ရပါသည္။

အစိုးရသစ္လက္ထက္တြင္ တိုးတက္ေျပာင္းလဲမႈ အနည္းငယ္ရွိေနသည္ဆိုေသာ္လည္း ဦးသိန္းစိန္ အစိုးရ၏လက္ထက္တြင္ ပထမဆံုး ဖမ္းဆီးခံခဲ့ရသည့္ ႏိုင္ငံေရးအက်ဥ္းသားျဖစ္သည့္ ကုိေနမ်ိဳးဇင္၏ အေျခအေနကို ၾကည့္ျခင္းအားျဖင့္ ျမန္မာႏုိင္ငံအတြင္းရွိ အက်ဥ္းေထာင္မ်ား၏ အေျခအေနသည္ ေျပာင္းလဲမႈမရွိသေလာက္ပင္ျဖစ္ေၾကာင္း ေတြ႔ရွိႏုိင္ပါသည္။

AAPP Urges the External Hospitalization for a Critically Ill Political Prisoner

AAPP has learned that Nay Myo Zin has been repeatedly denied vital medical care and has been unable to sit or walk without severe pain, causing him to forego his family visits. His repeated denials come at a time when the U Thein Sein administration granted an amnesty to those prisoners in poor health.

AAPP strongly urges the U Thein Sein administration to allow external hospitalization for this critically ill political prisoner. The health condition of Nay Myo Zin, former army captain turned charity worker recently sentenced to ten years under the notorious Electronic Transactions Act, has rapidly deteriorated since his initial arrest in May.

In physically good health upon arrest, he is now unable to walk and faces potential paralysis of his lower body due to appallingly inadequate medical care in Burma’s prisons, compounded by repeated denials of requests for external hospitalization. The severe pain he is being forced to endure has also prevented him from receiving family visits. The case of Nay Myo Zin amounts to a wholesale violation of his most basic prisoner rights, including the right to basic medical care and family visits. AAPP demands the relevant prison authorities to provide Nay Myo Zin with the urgent medical care he is rightfully entitled to under domestic law.

Nay Myo Zin, who was both physically and mentally tortured during his interrogation, is currently suffering from a broken hip and rib leaving him unable to walk or stand. Although he received an x-ray from the prison hospital confirming his grave injuries, repeated appeals to the prison doctor requesting a transfer to an appropriate medical facility have all gone denied. U Hla Myo Myint, Nay Myo Zin’s legal representative, decried the situation as unjust, stating he witnessed criminal offenders receive approval for their external hospitalization requests without delay. Nay Myo Zin has so far received nothing other than pills.

The prolonged mistreatment of Nay Myo Zin is a far cry from the recent amnesty that saw the release of prisoners in bad health. Unfortunately, there are still at least 122 political prisoners locked up and suffering from poor health. Among those in poor health are: Honney Oo, an ABFSU student serving a 9 and a half year sentence and now suffering gastric problems; and the famed student leader Min Ko Naing, who was not released in the recent presidential amnesty, is suffering from hypertension and heart conditions due to prison conditions.

The conditions in Burma’s prisons have remained appallingly far below minimum international standards to satisfy the most basic prisoner rights. Nay Myo Zin is being held in Insein prison, which is notorious for inadequate health care and only provides 3 doctors for 10,000 inmates. AAPP has documented at least 146 political prisoner deaths due to such deplorable conditions. The gross negligence for the care of political prisoners by the prison staff demands that resources outside of the prison be made available to those prisoners in need when the prison staff themselves cannot care for those inmates.

As the first political prisoner to be arrested under U Thein Sein administration, it serves as a cautious reminder that conditions inside Burma’s prisons are not changing quickly enough, despite overtures of progress by the administration.

“Given the recent so-called amnesty by the U Thein Sein administration and its intentions of releasing prisoners in poor health, it is decidedly unjust to not only keep Nay Myo Zin locked up on false charges, but also to deny him adequate and necessary medical care which is the right of prisoners and the responsibility of the authorities,” says AAPP Joint-Secretary Ko Bo Kyi.
