တရားစီရင္ေရး အမွန္တရားဘက္မွာ မရွိဘူးလို႔ ဘရန္ေရွာင္ေျပာ

လေထာ္ဘရန္ေရွာင္က ျမစ္ႀကီးနားၿမိဳ႕မွာ မေန႔က လူထု ရွင္းလင္းပြဲ တခုလုပ္ေဆာင္ခဲ့ပါတယ္။ တက္ေရာက္ လာသူ လူေပါင္း ၂၀၀၀ ေက်ာ္တယ္လုိ႔ သိရပါတယ္။ 

ျပည္တြင္း ေနရပ္ေျပာင္းေရႊ႕ ေနထုိင္သူ တဦးလည္း ျဖစ္တဲ့ လေထာ္ဘရန္ေရွာင္ဟာ သူ႔အေနနဲ႔ ဘယ္တုန္းကမွ KIA နဲ႔ ဆက္သြယ္ေဆာင္ရြက္ခဲ့တာ မရွိခဲ့ပဲ တရား႐ံုးမွာေရာ လူထုေရွ႕မွာပါ စမ္းသပ္ခံခဲ့ၿပီး ျဖစ္တယ္လုိ႔ သူ႔ရဲ႕ ထုတ္ျပန္ေၾကညာခ်က္မွာ ဆုိပါတယ္။ 

စစ္ေထာက္လွမ္းေရး စ အ ဖ က သူ႔ကုိ KIA စစ္ဗိုလ္ တဦးအျဖစ္ စြပ္စြဲကာ ဖမ္းဆီ တရားစြဲလုိ႔ ေထာင္ ၂ ႏွစ္ လည္း က်ခဲ့ရပါေသးတယ္။ အခု ေနာက္ဆံုး သမၼတရဲ႕ လြတ္ၿငိမ္္းခ်မ္းသာခြင့္နဲ႔မွ ျပန္လြတ္လာခဲ့တာပါ။

ေဒသခံေတြနဲ႔ မ်က္ျမင္ သက္ေသေတြရဲ႕ အေထာက္အထားေတြအရ သူဟာ KIA မဟုတ္ဘူးဆိုတဲ့ အမွန္တရား ကို သိလွ်က္နဲ႔ စ၊ အ၊ ဖက သူ႔ကို အတင္းဖမ္း၊ ေထာင္ခ်ခဲ့တာကို ကခ်င္ျပည္နယ္ အစုိးရက ႏွာေစးေနခဲ့တာ ကိုလည္း ဘရန္ေရွာင္က ထုတ္ျပန္ခ်က္မွာ ထည့္သြင္း ေဖာ္ျပထားပါတယ္။ 

သူအေနနဲ႔  မတရား ဖမ္းဆီးခံလိုက္ရတာဟာ တရားစီရင္ေရးမွာ အမွန္တရားဘက္က မရွိပဲ ယခင္ စစ္အစုိးရ တုန္းကလုိ လႊမ္းမုိးမႈ ရွိေနတယ္ဆုိတာ ျပသလိုက္တာ ေရာက္တယ္လို႔ သူက ထုတ္ျပန္ေၾကညာပါတယ္။ 

ဘရန္ေရွာင္ရဲ႕အဂၤလိပ္ဘာသာနဲ႔ ထုတ္ျပန္ထားတဲ့ ေၾကညာခ်က္ကိုလည္း ျပန္လည္ ေဖာ္ျပေပးလိုက္ပါတယ္။

1.  1.    Lahtaw brang shawng , ordinary citizen , internally displaced person who seek shelter at Jan  Mai Kawng Baptist Church compound. He , himself  testified  before court and public that he's had never joined  Kachin Independent Army.

2.   2.   Myanmar Military Intelligence (Sa Ya Hpa)  took him from IDP camp and tortured him forced to admit that he was KIA soilder.  Myanmar Military Intelligence had accused him as captain from KIA at first later  they accuse again as  Corporal and jailed him for 2 year of what he never done.

3.  3.    It was obvious that Kachin state government ignored the truth,  even they all  see and hear many evidence and witness that brang shawng is not KIA  but can't resist pressure  from Myanmar Military Intelligence ( Sa Ya Hpa ) and allowed them to influence upon judicial system. And Kachin state government work together with Sa Ya Hpa to put brang shawng in jail.  

4.  4.   Kachin state government and state court  verdict  on lahtaw brang shang case clearly  show  although country was moving for democracy Burma's judicial system and rule of law are not based on truth, still under the influence and control of Military as before. 

Recommendation to government

-          To stop serious violation of human rights , arbitrary  arrestment , torturing ,   intimidating of  civilian  by both TatMadaw and authority.  

-          To take immediate action upon such human rights violation.

-          Rehabilitate and compensate according to law for those who had affected by violation. 

Recommendation to international community 

-          Closely watch and help to prevent human right violation in Kachin state.

-          Help and stand together to government to respect human rights.

-          Continued humanitarian assistance to war affected people.

-          Closely watch judicial system of Kachin state and help to form free and ္justice  judicial system.
