တခ်ိန္က စစ္အစုိးရလက္ထက္တေလွ်ာက္ ျမန္မာႏုိင္ငံမွာ လြတ္လပ္စြာ အသင္းအဖြဲ႔ ဖြဲ႔စည္းဖုိ႔ ဆုိတာ အိပ္မက္ အလား ခက္ခဲပါတယ္။ ရွိခဲ့တဲ့ အသင္းအဖြဲ႔ဆုိတာကလည္း အစုိးရ ေက်ာေထာက္ေနာက္ခံေပးတဲ့ အသင္းအဖြဲ႔မ်ိဳးက မ်ားပါတယ္။

ရပ္ထဲ၊ ရြာထဲက ဆြမ္းေတာ္ႀကီး ၀တ္အသင္း ဆုိတာေလာက္ပဲ အစုိးရနဲ႔ နည္းနည္း ကင္းတယ္ေျပာလို႔ရတယ္။ ဒါေတာင္ တခါတေလ အစုိးရရဲ႕ အစြယ္အပြားပံုစံ ျဖစ္သြားတတ္ၾကပါေသးတယ္။

ဒီမုိကေရစီ အသြင္ကူးေျပာင္းေရး ကာလမွာ အေရးႀကီးတဲ့ အခန္းက႑မွာ ပါ၀င္တဲ့ အသင္းအဖြဲ႔နဲ႔ ပတ္သက္တဲ့ မွတ္ပံုတင္ျခင္း ဥပေဒကို ဧရာ၀တီ ပရိသတ္ေတြလည္း သိထားသင့္ၾကမယ္ ထင္ပါတယ္။ အသင္း အဖြဲ႔ မွတ္ပံုတင္ျခင္းဆုိင္ရာ ဥပေဒေဖာ္ျပခ်က္ပါ။ 

အခန္း(၁) အမည္နွင့္အဓိပၸါယ္ေဖာ္ျပခ်က္ ၁။       ဤဥပေဒကို အသင္းအဖြဲ႕မ်ား မွတ္ပုံတင္ျခင္းဆိုင္ရာဥပေဒ ဟုေခၚတြင္ေစရမည္။ ၂။       ဤဥပေဒတြင္ပါရွိေသာ ေအာက္ပါစကားရပ္မ်ားသည္ ေဖာ္ျပပါအတိုင္း အဓိပၸါယ္သက္ေရာက္ ေစရမည္ - (က)    “နိဳင္ငံေတာ္”  ဆိုသည္မွာ ျပည္ေထာင္စုသမၼတျမန္မာနိဳင္ငံေတာ္ကို ဆိုသည္။ (ခ)     “အစိုးရအဖြဲ႕” ဆိုသည္မွာ ျပည္ေထာင္စုသမၼတျမန္မာနိဳင္ငံေတာ္ ျပည္ေထာင္စုအစိုးရ အဖြဲ႕ကို ဆိုသည္။ (ဂ)     “နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႕မ်ားမွတ္ပုံတင္ေရးအဖြဲ႕” ဆိုသည္မွာ ျပည္ေထာင္စုအစိုးရအဖြဲ႕က ဖြဲ႕စည္း တာဝန္ေပးအပ္ေသာ နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႕မ်ားမွတ္ပုံတင္ေရး ေဆာင္ရြက္ ေပးသည့္ အဖြဲ႕ကိုဆိုသည္။   (ဃ)    “တိုင္းေဒသႁႀကီး/ပည္နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႕” ဆိုသည္မွာ တိုင္းေဒသႀကီး/ ျပည္နယ္ အစိုးရအဖြဲ႕က ဖြဲ႕စည္းတာဝန္ေပးအပ္ေသာ တိုင္းေဒသႀကီး/ျပည္နယ္အဆင့္ အသင္းအဖြဲ႕မ်ား မွတ္ပုံတင္ေရး ေဆာင္ရြက္ေပးသည့္အဖြဲ႕ကို ဆိုသည္။ (င)     “ေနျပည္ေတာ္ေကာင္စီနယ္ေျမမွတ္ပုံတင္ေရးအဖြဲ႕”ဆိုသည္မွာ ေနျပည္ေတာ္ေကာင္စီက ဖြဲ႕စည္း တာဝန္ေပးအပ္ေသာေနျပည္ေတာ္ေကာင္စီအဆင့္ အသင္းအဖြဲ႕မ်ားမွတ္ပုံတင္ေရး ေဆာင္ရြက္ေပးသည့္ အဖြဲ႕ကို ဆိုသည္။ (စ)     “ခရိုင္္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႕”ဆိုသည္မွာကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရတိုင္းဦးစီးအဖြဲ႕ သို႔မဟုတ္ ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရေဒသဦးစီးအဖြဲ႕ သို႔မဟုတ္ ခရိုင္အေထြေထြအုပ္ခ်ဳပ္ေရး ဦးစီးဌာနက   ဖြဲ႕စည္းတာဝန္ေပးအပ္ေသာ ခရိုင္အဆင့္အသင္းအဖြဲ႕မ်ားမွတ္ပုံတင္ေရး ေဆာင္ရြက္ ေပးသည့္အဖြဲ႕ကို ဆိုသည္။ (ဆ)    “ၿမိဳ့နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႕”ဆိုသည္မွာ ၿမိဳ့နယ္အေထြေထြအုပ္ခ်ဳပ္ေရး ဦးစီးဌာနက ဖြဲ႕စည္းတာဝန္ေပးအပ္ေသာ ၿမိဳ့နယ္အဆင့္အသင္းအဖြဲ႕မ်ား မွတ္ပုံတင္ေရးေဆာင္ရြက္ ေပးသည့္ အဖြဲ႕ကိုဆိုသည္။ (ဇ)     “ျပည္တြင္းအသင္းအဖြဲ႕” ဆိုသည္မွာ နိဳင္ငံေတာ္နွင့္နိဳင္ငံသားမ်ားအက်ိဳးအလို့ငွါ ဖြဲ႕စည္းပုံ အေျခခံဥပေဒပါ အခြင့္အေရးမ်ားနွင့္အညီ ရည္ရြယ္ခ်က္တစ္ခုခု သို႔မဟုတ္ လုပ္ငန္းစဉ္ တစ္ခုခုအတြက္ေသာ္လည္းေကာင္း၊ အဖြဲ႕ဝင္မ်ား၏ ဘုံအက်ိဳးစီးပြားအတြက္ ေသာ္လည္းေကာင္း    နွစ္ဦးသို႔မဟုတ္ နွစ္ဦးထက္ပိုေသာ လူအမ်ားစုေပါင္း ဖြဲ႕စည္း ထားသည့္ အက်ိဳးအျမတ္မယူေသာ ျပည္တြင္းလူမႈေရး အသင္းအဖြဲ႕ကို ဆိုသည္။ ယင္းစကားရပ္တြင္ အသင္းအဖြဲ႕မ်ား၏  အဖြဲ႕ခြဲမ်ားလည္း ပါဝင္သည္။ (ဈ)     “နိဳင္ငံတကာအစိုးရမဟုတ္ေသာအသင္းအဖြဲ႕” ဆိုသည္မွာ နိဳင္ငံျခားတိုင္းျပည္တစ္ခုခုတြင္  မွတ္ပုံတင္္ထားေသာအဖြဲ႕အစည္းျဖစ္ၿပီး  ျပည္ေထာင္စုအစိုးရအဖြဲ႕၏ သေဘာတူခြင့္ျပဳခ်က္ ျဖင့္ နိဳင္ငံေတာ္အတြင္း လူမႈေရးလုပ္ငန္း တစ္ရပ္ရပ္ကိုေဆာင္ရြက္ရန္ ရည္ရြယ္ သည့္အဖြဲ႕အစည္း ကို ဆိုသည္။ (ည)    “မွတ္ပုံတင္လက္မွတ္” ဆိုသည္မွာ  နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႕အျဖစ္ အသိအမွတ္ျပဳလက္မွတ္ သို႔မဟုတ္ ျပည္တြင္းအသင္းအဖြဲ႕ အျဖစ္အသိအမွတ္ျပဳ လက္မွတ္ ကိုဆိုသည္။ (ဋ)     “ဝန္ႀကီးဌာန” ဆိုသည္မွာ ျပည္ေထာင္စုသမၼတျမန္မာနိဳင္ငံေတာ္အစိုးရ၊ ျပည္ထဲေရး ဝန္ႀကီးဌာနကို ဆိုသည္။ (ဌ)     “ဦးစီးဌာန” ဆိုသည္မွာ ျပည္ထဲေရးဝန္ႀကီးဌာန အေထြေထြအုပ္ခ်ဳပ္ေရးဦးစီးဌာန ကို     ဆိုသည္။ (ဍ)     “ညႊန္ၾကားေရးမႉးခ်ုပ္” ဆိုသည္မွာ အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန  ညႊန္ၾကားေရး မႉးခ်ုပ္ကို ဆိုသည္။ (ဎ)     “ညႊန္ၾကားေရးမႉး” ဆိုသည္မွာ အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန၊ ညႊန္ၾကားေရးမႉးခ်ုပ္က တာဝန္ေပးအပ္ထားေသာ ညႊန္ၾကားေရးမႉးကို ဆိုသည္။

အခန္း(၂) ရည္ရြယ္ခ်က္ ၃။       ဤဥပေဒ၏ရည္ရြယ္ခ်က္မ်ားမွာ ေအာက္ပါအတိုင္းျဖစ္သည္ - (က)    အသင္းအဖြဲ႕မ်ားမွတ္ပုံတင္ျခင္းနွင့့့္ နိုင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႕မ်ား မွတ္ပုံတင္ျခင္းတို႔ကို ဤဥပေဒနွင့္အညီ  က်င့္သုံးေဆာင္ရြက္ နိုင္ေစရန္၊ (ခ)     အသင္းအဖြဲ႕မ်ားကို စနစ္တက်နွင့္ လြတ္လပ္စြာဖြဲ႕စည္း လႈပ္ရွားေဆာင္ရြက္နိုင္ေစရန္၊ (ဂ)     အသင္းအဖြဲ႕မ်ား၏ ေဆာင္ရြက္ခ်က္မ်ားသည္ နိဳင္ငံေတာ္ဖြံ့ၿဖိဳးတိုးတက္မႈနွင့္ နိဳင္ငံသားမ်ားအက်ိဳးကို  အေထာက္အကူျပဳ နိဳင္ေစရန္။ (ဃ)    အသင္းအဖြဲ႕မ်ားသည္လုပ္ငန္းမ်ား အေကာင္အထည္ေဖာ္ေဆာင္ရြက္ရာတြင္ သက္ဆိုင္ ရာဝန္ႀကီးဌာနမ်ားထံမွဥပေဒနွင့္အညီ လိုအပ္သည့္အကူအညီမ်ား ရယူနိဳင္ရန္။ (င)     အရပ္ဘက္လူ့အဖြဲ႕အစည္းမ်ား ခိုင္မာအားေကာင္းေစရန္။

အခန္း(၃) မွတ္ပုံတင္ေရးအဖြဲ႔အဆင့္ဆင့္ဖြဲ႔စည္းျခင္းနွင့္ လုပ္ငန္းတာဝန္မ်ား ၄။       အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ေရးအတြက္ မွတ္ပုံတင္ေရးအဖြဲ႔ အဆင့္ဆင့္ကို ေအာက္ပါအတိုင္း ဖြဲ႔စည္းရမည္ -           (က)    နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ေရးအဖြဲ႔           (ခ)     တိုင္းေဒသႀကီး/ျပည္နယ္အဆင့္ အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ေရးအဖြဲ႔           (ဂ)     ေနျပည္ေတာ္ေကာင္စီအဆင့္ အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ေရးအဖြဲ႔           (ဃ)    ခရိုင္အဆင့္အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ေရးအဖြဲ႔           (င)     ၿမိဳ့နယ္အဆင့္ အသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ေရးအဖြဲ႔ ၅။       ပုဒ္မ(၄)တြင္ ေဖာ္ျပပါရွိေသာ မွတ္ပုံတင္ေရးအဖြဲ႔အဆင့္ဆင့္အား ေအာက္ပါအတိုင္းဖြဲ႔စည္းရမည္ - (က)    နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ေရးအဖြဲ႔ ဖြဲ႔စည္းျခင္း။ ျပည္ေထာင္စုအစိုးရအဖြဲ႔သည္ နိဳင္ငံတကာအစိုးရမဟုတ္ေသာအသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ ေရးအဖြဲ႔အား ေအာက္ပါပုဂၢိဳလ္မ်ား ပါဝင္ဖြဲ႔စည္းရမည္ -           (၁)     ျပည္ေထာင္စုဝန္ႀကီး၊ျပည္ထဲေရးဝန္ႀကီးဌာန                 ဥကၠ႒           (၂)     ဒုတိယဝန္ႀကီး၊နိဳင္ငံေတာ္သမၼတရုံး                           အဖြဲ႔ဝင္           (၃)     ဒုတိယဝန္ႀကီး၊နိဳင္ငံျခားေရးဝန္ႀကီးဌာန                       အဖြဲ႔ဝင္                     (၄)     ဒုတိယဝန္ႀကီး၊အမ်ိဳးသားစီမံကိန္းနွင့္စီးပြားေရး               အဖြဲ႔ဝင္                    ဖြံ့ၿဖိဳးတိုးတက္မႈဝန္ႀကီးဌာန           (၅)     ညႊန္ၾကားေရးမႉးခ်ုပ္၊ အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန အတြင္းေရးမႉး          (ခ)     တိုင္းေဒသႀကီး/ျပည္နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔ ဖြဲ႔စည္းျခင္း။          တိုင္းေဒသႀကီး/ ျပည္နယ္ အစိုးရအဖြဲ႔သည္တိုင္းေဒသႀကီး သို႔မဟုတ္ ျပည္နယ္အဆင့္ မွတ္ပုံတင္ေရးအဖြဲ႔အား ေအာက္ပါပုဂၢိုလ္မ်ား ပါဝင္ဖြဲ႔စည္းရမည္ -                    (၁)     လူမႈေရးရာဝန္ႀကီး                                     ဥကၠ႒                    (၂)     တိုင္းေဒသႀကီး/ျပည္နယ္ရဲတပ္ဖြဲ႔မႉး                  အဖြဲ႔ဝင္                    (၃)     တိုေင္းဒသႀကီး/ ျပည္နယ္အသင္းအဖြဲ႔မ်ားမွ        အဖြဲ႔ဝင္                              ေရြးခ်ယ္ေသာ ကိုယ္စားလွယ္နွစ္ဦး                    (၄)     ညႊန္ၾကားေရးမႉး၊တိုင္းေဒသႀကီး/ ျပည္နယ္ အတြင္းေရးမႉး                              အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန (ဂ)     ေနျပည္ေတာ္ေကာင္စီနယ္ေျမ မွတ္ပုံတင္ေရးအဖြဲ႔ ဖြဲ႔စည္းျခင္း။          ေနျပည္ေတာ္ေကာင္စီ သည္ ေနျပည္ေတာ္ေကာင္စီအဆင့္ မွတ္ပုံတင္ေရးအဖြဲ႔အား ေအာက္ပါပုဂၢိုလ္မ်ားပါဝင္ ဖြဲ႔စည္းရမည္ -           (၁)     ေနျပည္ေတာ္ေကာင္စီဝင္တစ္ဦး                               ဥကၠ႒           (၂)     ေနျပည္ေတာ္ရဲတပ္ဖြဲ႔မႉး၊ ျမန္မာနိုင္ငံရဲတပ္ဖြဲ႔                  အဖြဲ႔ဝင္           (၃)     ေနျပည္ေတာ္ေကာင္စီ အသင္းအဖြဲ႔မ်ားမွ                     အဖြဲ႔ဝင္                    ေရြးခ်ယ္ေသာ ကိုယ္စားလွယ္နွစ္ဦး           (၄)     ညႊန္ၾကားေရးမႉး၊ ေနျပည္ေတာ္                       အတြင္းေရးမႉး                       အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန  (ဃ)   ခရိုင္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔ ဖြဲ႔စည္းျခင္း။ ကိုယ္ပိုင္အုပ္ခ်ုပ္ခြင့္ရတိုင္းဦးစီးအဖြဲ႔ သို႔မဟုတ္ ကိုယ္ပိုင္အုပ္ခ်ုပ္ခြင့္ရေဒသဦးစီးအဖြဲ႔ သို႔မဟုတ္ ခရိုင္အုပ္ခ်ုပ္ေရးမႉး၊ ခရိုင္ အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာနသည္ ခရိုင္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔အား ေအာက္ပါပုဂၢိုလ္ မ်ား  ပါဝင္ဖြဲ႔စည္းရမည္ -           (၁)     ခရိုင္အုပ္ခ်ုပ္ေရးမႉး၊ ခရိုင္အေထြေထြအုပ္ခ်ုပ္ေရးဦးစီးဌာန   ဥကၠ႒           (၂)     ခရိုင္ရဲတပ္ဖြဲ႔မႉး၊ ျမန္မာနိုင္ငံရဲတပ္ဖြဲ႔                            အဖြဲ႔ဝင္           (၃)     ခရိုင္အဆင့္အသင္းအဖြဲ႔မ်ားမွ ေရြးခ်ယ္ေသာ                 အဖြဲ႔ဝင္                    ကိုယ္စားလွယ္ နွစ္ဦး           (၄)     လက္ေထာက္ညႊန္ၾကားေရးမႉး၊ ခရိုင္အေထြေထြ    အတြင္းေရးမႉး                    အုပ္ခ်ုပ္ေရး ဦးစီးဌာန    (င)     ၿမိဳ႕နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔ ဖြဲ႔စည္းျခင္း။      ၿမိဳ႕နယ္အုပ္ခ်ုပ္ေရးမႉး၊ ၿမိဳ႕နယ္အေထြေထြ အုပ္ခ်ုပ္ေရးဦးစီးဌာနသည္ ၿမိဳ႕နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔အား ေအာက္ပါပုဂၢိုလ္မ်ား ပါဝင္ဖြဲ႔စည္းရမည္ -           (၁)     ၿမိဳ႕နယ္အုပ္ခ်ုပ္ေရးမႉး၊ ၿမိဳ႕နယ္ေအ‌ေထြထြ                              ဥကၠ႒                    အုပ္ခ်ုပ္ေရးဦးစီးဌာန               (၂)     ၿမိဳ႕နယ္ရဲတပ္ဖြဲ႔မႉး၊ ျမန္မာနိုင္ငံရဲတပ္ဖြဲ႔                         အဖြဲ႔ဝင္           (၃)     ၿမိဳ႕နယ္အဆင့္ အသင္းအဖြဲ႔မ်ားမွေရြးခ်ယ္ေသာ              အဖြဲ႔ဝင္                    ကိုယ္စားလွယ္ နွစ္ဦး           (၄)     ဦးစီးအရာရွိ၊ ၿမိဳ့နယ္အေထြေထြအုပ္ခ်ဳပ္ေရးဦးစီးဌာန အတြင္းေရးမႉး ၆။       မွတ္ပုံတင္ေရးအဖြဲ႔အဆင့္ဆင့္၏လုပ္ငန္းတာဝန္မ်ားမွာ ေအာက္ပါအတိုင္းျဖစ္သည္ - (က)    အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ခြင့္ျပဳရန္ ေလွ်ာက္ထားျခင္းမ်ားနွင့္စပ္လ်ဉ္း၍ အဆုံးအျဖတ္ ေပးျခင္း၊ (ခ)     အသင္းအဖြဲ႔မ်ားအား မွတ္ပုံတင္လက္မွတ္ထုတ္ေပးျခင္းနွင့္ လဲလွယ္ေပးျခင္း၊ (ဂ)     အသင္းအဖြဲ႔မ်ားအား ဥပေဒနွင္‌့အညီ  ေဆာင္ရြက္ေစျခင္းနွင့္ကူညီေပးျခင္း၊ (ဃ)    အသင္းအဖြဲ႔မ်ား၏ရည္ရြယ္ခ်က္နွင့္ လုပ္ငန္းစဉ္မ်ား လြယ္ကူေခ်ာေမြ့ေစရန္ သက္ဆိုင္ ရာဌာနမ်ားနွင့္ ေပါင္းစပ္ညွိနႈိင္းေပးျခင္း၊ (င)     နိုင္ငံတကာအစိုးရမဟုတ္ေသာအသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ေရးအဖြဲ႔သည္ နိုင္ငံတကာ အစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ားအား မွတ္ပုံတင္ခြင့္ျပဳျခင္းနွင့္ သက္တမ္းတိုးျမွင့္ေပးျခင္း၊

အခန္း(၄) ျပည္တြင္းအသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ခြင့္ျပဳျခင္း ၇။       အသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္လိုပါက အသင္းအဖြဲ႔၏ ဥကၠ႒၊ အတြင္းေရးမႉး သို႔မဟုတ္ တာဝန္ခံ ပုဂၢိုလ္သည္ သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔သို႔ အသင္းအဖြဲ႔၏ဆနၵအေလ်ာက္  ေအာက္ပါသတ္မွတ္ခ်က္မ်ားနွင့္ အညီ ေလွ်ာက္ထားရမည္-           (က)    အသင္းအဖြဲ႔အမည္           (ခ)     တည္ေနရာနွင့္ဆက္သြယ္ရန္လိပ္စာ           (ဂ)     စတင္တည္ေထာင္သည့္ေန့           (ဃ)    ရည္ရြယ္ခ်က္           (င)     လုပ္ငန္းစဉ္           (စ)     အမႈေဆာင္ဦးေရ           (ဆ)    အသင္းဝင္ဦးေရ           (ဇ)     အသင္းပိုင္ေငြေၾကးနွင့္ပစၥည္းစာရင္း           (ဈ)     ေဆာင္ရြက္ခဲ့သည့္လုပ္ငန္းမ်ား           (ည)    ဖြဲ႔စည္းပုံနွင့္စည္းမ်ဉ္း           (ဋ)     သီးျခားတင္ျပခ်က္           (ဌ)     ေလွ်ာက္ထားသည့္ရက္စြဲ ၈။       သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔သည္ ပုဒ္မ ၇ အရ  မွတ္ပုံတင္လက္မွတ္ရရွိရန္ ေလွ်ာက္ထားလာေသာ အသင္းအဖြဲ႔အား ခုနစ္ ရက္အတြင္းယာယီ မွတ္ပုံတင္လက္မွတ္ကို ထုတ္ေပးရမည္။ ဆက္လက္၍ သတ္မွတ္ခ်က္မ်ားနွင့္အညီစိစစ္ၿပီး - (က)    အသင္းအဖြဲ႔အျဖစ္ မွတ္ပုံတင္ခြင့္ျပဳရန္ဆုံးျဖတ္ပါက ေလွ်ာက္လႊာလက္ခံရရိွသည့္ေန့ မွစ၍ မွတ္ပုံတင္လက္မွတ္ကို ေအာက္ေဖာ္ျပပါသတ္မွတ္ကာလအတြင္း ေလွ်ာက္ထား သူအား ထုတ္ေပးရမည္ -           (၁)     ျပည္ေထာင္စုအဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔                       (၆၀) ရက္           (၂)     တိုင္းေဒသႀကီး သို႔မဟုတ္ ျပည္နယ္အဆင့္                  (၆၀) ရက္                    မွတ္ပုံတင္ေရးအဖြဲ႔           (၃)     ေနျပည္ေတာ္နယ္ေျမအဆင့္ မွတ္ပုံတင္ေရးအဖြဲ႔             (၆၀)  ရက္          (၄)     ခရိုင္/ ၿမိဳ႕နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔                      (၃၀)ရက္ (ခ)     မွတ္ပုံတင္ခြင့္ရရွိသည့္ အသင္းအဖြဲ႔သည္ သတ္မွတ္ထားေသာ မွတ္ပုံတင္ေၾကး ကို ေပးသြင္းရမည္။ (ဂ)     အသင္းအဖြဲ႔အျဖစ္ မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္း ဆုံးျဖတ္ပါက က်ိုးေၾကာင္းျပည့္စုံစြာ ေဖာ္ျပ၍ မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္း ျပန္ၾကားစာကိုေအာက္ေဖာ္ျပပါ သတ္မွတ္ကာလအတြင္း ေလွ်ာက္ထားသူအား ျပန္ၾကားရမည္ -           (၁)     ျပည္ေထာင္စုအဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔                       (၃၀) ရက္           (၂)     တိုင္းေဒသႀကီး သို႔မဟုတ္ ျပည္နယ္အဆင့္                  (၃၀) ရက္                    မွတ္ပုံတင္ေရးအဖြဲ႔           (၃)     ေနျပည္ေတာ္နယ္ေျမအဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔              (၃၀)  ရက္          (၄)     ခရိုင္/ၿမိဳ့နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔                        (၁၅)ရက္ (ဃ)    သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔က မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္း  အေၾကာင္းျပန္ၾကားစာ လက္ခံ ရရွိပါကခြင့္မျပဳေသာအေၾကာင္းရင္းကို သက္ဆိုင္ရာ မွတ္ပုံတင္ေရးအဖြဲ႔နွင့္ ေဆြးေႏြး၍  အယူခံဝင္ခြင့္ရွိသည္။ ၉။       တိုင္းေဒသႀကီး/ျပည္နယ္အဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔တြင္ မွတ္ပုံတင္ထားေသာ အသင္းအဖြဲ႔ သည္အျခား တိုင္း ေဒသႀကီးနွင့္ျပည္နယ္အားလုံးတြင္ လႈပ္ရွားေဆာင္ရြက္လိုပါက သက္ဆိုင္ရာ တိုင္းေဒသႀကီး/ျပည္နယ္ မွတ္ပုံတင္ေရးအဖြဲ႔၏ ခြင့္ျပဳခ်က္ျဖင့္ ေဆာင္ရြက္ခြင့္ ရွိၿပီးမွတ္ပုံတင္ေၾကး ( ၃၀၀၀၀ )က်ပ္ သတ္မွတ္သည္။ ၁၀။     ေနျပည္ေတာ္ေကာင္စီနယ္ေျမ မွတ္ပုံတင္ေရးအဖြဲ႔တြင္ မွတ္ပုံတင္ထားေသာ အသင္းအဖြဲ႔သည္ သက္ဆိုင္ရာတိုင္းေဒသႀကီးအတြင္း လႈပ္ရွားေဆာင္ရြက္ခြင့္ရွိၿပီး မွတ္ပုံတင္ေၾကး (၃၀၀၀၀)က်ပ္ သတ္မွတ္ သည္။ ၁၁။     ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရတိုင္း သို႔မဟုတ္ ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရေဒသ သို႔မဟုတ္ ခရိုင္တစ္ခုအတြင္း၌ မွတ္ပုံတင္ထားေသာအသင္းအဖြဲ႔သည္ သက္ဆိုင္ရာ တိုင္းေဒသႀကီးအတြင္း လႈပ္ရွားေဆာင္ရြက္လိုပါက သက္ဆိုင္ရာ ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရတိုင္း သို႔မဟုတ္ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရ ေဒသ သို႔မဟုတ္ ခရိုင္ မွတ္ပုံတင္ေရးအဖဲြ့၏  ခြင့္ျပဳခ်က္ျဖင့္ ေဆာင္ရြက္ခြင့္ရွိၿပီး မွတ္ပုံတင္ေၾကး (၁၀၀၀၀)က်ပ္ သတ္မွတ္ သည္။ ၁၂။     ၿမိဳ့နယ္မွတ္ပုံတင္ေရးအဖြဲ႔တြင္ မွတ္ပုံတင္ထားေသာအသင္းအဖြဲ႔သည္ သက္္ဆိုင္ရာကိုယ္ပိုင္ အုပ္ခ်ဳပ္ခြင့္ရတိုင္း သို႔မဟုတ္ကိုယ္ပိုင္အုပ္ခ်ဳပ္ခြင့္ရေဒသ သို႔မဟုတ္ ခရိုင္တစ္ခုအတြင္း လႈပ္ရွားလိုပါက သက္ဆိုင္ရာ ၿမိဳ့နယ္မွတ္ပုံတင္ေရးအဖြဲ႔၏ခြင့္ျပဳခ်က္ျဖင့္ ေဆာင္ရြက္ခြင့္ရွိၿပီး မွတ္ပုံတင္ေၾကးေပးသြင္း ရန္မလို။

အခန္း(၅) နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ားမွတ္ပုံတင္ခြင့္ျပဳျခင္း ၁၃။     နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔တစ္ခုခုသည္  မွတ္ပုံတင္လက္မွတ္ရရွိရန္ အတြက္ ေအာက္ပါသတ္မွတ္ခ်က္မ်ားနွင့္အညီ  ယင္းအသင္းအဖြဲ႔၏တာဝန္ခံက နိဳင္ငံတကာအစိုးရ မဟုတ္ေသာအသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ေရးအဖြဲ႔သို႔ ေလွ်ာက္ထားရမည္-           (က)    အသင္းအဖြဲ႔အမည္           (ခ)     အႀကီးအကဲအမည္           (ဂ)     တာဝန္ခံအမည္           (ဃ)    တည္ေနရာနွင့္ဆက္သြယ္ရန္လိပ္စာ           (င)     အသင္းအေျခစိုက္နိဳင္ငံ           (စ)     ျမန္မာနိဳင္ငံတြင္ေဆာင္ရြက္မည့္လုပ္ငန္း           (ဆ)    ဆက္သြယ္ေဆာင္ရြက္မည့္ဝန္ႀကီးဌာနမ်ား           (ဇ)     လုပ္ငန္းစီမံခ်က္           (ဈ)     အမႈေဆာင္အဖြဲ႔ဝင္ဦးေရ           (ည)    ရုံးခြဲတည္ေနရာနွင့္ဆက္သြယ္ရန္လိပ္စာ           (ဋ)     ရုံးခြဲတာဝန္ခံအမည္           (ဌ)     ေလွ်ာက္ထားသည့္ရက္စြဲ          ၁၄။     သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔သည္ ပုဒ္မ ၁၃ အရ  မွတ္ပုံတင္လက္မွတ္ရရွိရန္ ေလွ်ာက္ထား လာေသာ အသင္းအဖြဲ႔အား ခုနစ္ရက္ အတြင္းယာယီ မွတ္ပုံတင္လက္မွတ္ကို ထုတ္ေပးရမည္။ ဆက္လက္၍ သတ္မွတ္ခ်က္မ်ားနွင့္ အညီစိစစ္ၿပီး-  (က)   အသင္းအဖြဲ႔အျဖစ္  မွတ္ပုံတင္ခြင့္ျပဳရန္ဆုံးျဖတ္ပါက ေလွ်ာက္လႊာကို လက္ခံရရွိ သည့္ ေန့မွစ၍ ရက္ေပါင္း(၉၀)အတြင္းေလွ်ာက္ထားသူအား မွတ္ပုံတင္လက္မွတ္ကိုထုတ္ ေပးရမည္။ ( ခ )   မွတ္ပုံတင္ခြင့္ရရွိသည့္ အသင္းအဖြဲ႔သည္ သတ္မွတ္ထားေသာ မွတ္ပုံတင္ေၾကးကို ေပးသြင္းရမည္။ မွတ္ပုံတင္ေၾကး ( ၁၀၀၀၀၀ )က်ပ္ သတ္မွတ္သည္။ (ဂ)     အသင္းအဖြဲ႔အျဖစ္ မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္းဆုံးျဖတ္ပါက က်ိုးေၾကာင္းျပည့္စုံစြာေဖာ္ျပ၍ မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္း ရက္ေပါင္း(၃၀)အတြင္း ျပန္ၾကားစာကို ေလွ်ာက္ထားသူအား ျပန္ၾကားရမည္။ (ဃ)    သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔က မွတ္ပုံတင္ခြင့္မျပဳေၾကာင္း  အေၾကာင္းျပန္ၾကားစာလက္ခံ ရရွိပါက ခြင့္မျပဳေသာအေၾကာင္းရင္းကို သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔နွင့္ ေဆြးေႏြး ၍  အယူခံဝင္ခြင့္ရွိသည္။

အခန္း(၆) မွတ္ပုံတင္ခြင့္ေလွ်ာက္ထားရန္မလိုေသာအသင္းအဖြဲ႔မ်ား ၁၅။     ဤဥပေဒအရ မွတ္ပုံတင္ခြင့္ေလ်ာက္ထားရန္မလိုေသာ အသင္းအဖြဲ႔မ်ားမွာ ေအာက္ပါအတိုင္း ျဖစ္သည္- (က)    ဘာသာေရး၊  သာသနာေရးနွင့္ စီးပြားေရးသက္သက္ကိုသာ က်င့္သုံးေဆာင္ရြက္ေသာ အသင္းအဖြဲ႔မ်ား၊ (ခ)     နိဳင္ငံေရးပါတီမ်ား မွတ္ပုံတင္ျခင္းဥပေဒအရ ျပည္ေထာင္စုေရြးေကာက္ပြဲေကာ္မရွင္သို႔ ေလွ်ာက္ထားရမည့္ နိဳင္ငံေရးအသင္းအဖြဲ႔မ်ား၊ (ဂ)     တည္ဆဲဥပေဒတစ္ရပ္ရပ္အရ မွတ္ပုံတင္ထားေသာအသင္းအဖြဲ႔မ်ား၊

အခန္း(၇) အသင္းအဖြဲ႔မ်ား၏ မွတ္ပုံတင္လက္မွတ္လဲလွယ္ျခင္း ၁၆။     မွတ္ပုံတင္လက္မွတ္ရရွိထားေသာ အသင္းအဖြဲ႔မ်ားသည္သက္ဆိုင္ရာ မွတ္ပုံတင္ေရးအဖြဲ႔သို႔ တစ္နွစ္ တစ္ႀကိမ္ နွစ္ပတ္လည္အစီရင္ခံစာ တင္ျပရမည္။ နွစ္စဉ္နွစ္ပတ္လည္အစီရင္ခံစာ ပုံမွန္တင္ျပျခင္းျဖင့္ ၎င္းအသင္းအဖြဲ႔သည္ ဆက္လက္တည္ရွိေနသည္ဟု မွတ္ယူ၍ငါးနွစ္လွ်င္တစ္ႀကိိမ္ မွတ္ပုံတင္လက္မွတ္ အသစ္လဲလွယ္ရမည္။ ထိုသို႔လဲလွယ္ျခင္းအတြက္ မွတ္ပုံတင္ေၾကးေပးေဆာင္ရန္မလို။  ၁၇။     မွတ္ပုံတင္လက္မွတ္ရရွိထားေသာ အသင္းအဖြဲ႔မ်ားသည္ သက္ဆိုင္ရာ မွတ္ပုံတင္အဖြဲ႔သို႔ တစ္နွစ္ တစ္ႀကိမ္ နွစ္ပတ္လည္အစီရင္ခံစာတင္ျပရန္နွင့္  (၅)နွစ္ဆက္တိုက္ပ်က္ကြက္ပါက ယင္းအသင္းအဖြဲ႔သည္ လႈပ္ရွားရပ္တည္ ေဆာင္ရြက္မႈမရွိဟု မွတ္ယူမည္ျဖစ္ၿပီး ဆက္လက္လႈပ္ရွားေဆာင္ရြက္လိုပါက မွတ္ပုံတင္ အသစ္ေလွ်ာက္ထားသကဲ့သို႔  ျပန္လည္ေလွ်ာက္ထားရမည္။ ၁၈။     သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔က မွတ္ပုံတင္လက္မွတ္လဲလွယ္ေပးရန္ ျငင္းပယ္ျခင္းခံရသည့္ ျပည္တြင္းအသင္းအဖြဲ႔မ်ားသည္ အေၾကာင္းျပန္ၾကားစာ လက္ခံရရွိပါက ရက္ေပါင္း(၉၀)အထိ ဆက္လက္ ရပ္တည္နိဳင္ခြင့္ရွိသည့္အျပင္ ခြင့္မျပဳေသာအေၾကာင္းရင္းကို သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔နွင့္ ေဆြးေႏြး၍ အယူခံဝင္ခြင့္  ရွိသည္။  ၁၉။     သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔က မွတ္ပုံတင္လက္မွတ္လဲလွယ္ေပးရန္ ျငင္းပယ္ျခင္းခံရသည့္ နိဳင္ငံတကာအစိုးရ မဟုတ္ေသာ အသင္းအဖြဲ႔မ်ားသည္ အေၾကာင္းျပန္ၾကားစာ လက္ခံရရွိပါက ရက္ေပါင္း (၁၈၀) အထိ ဆက္လက္ရပ္တည္နိဳင္ခြင့္ရွိသည့္အျပင္ခြင့္မျပဳေသာအေၾကာင္းရင္းကို သက္ဆိုင္ရာ မွတ္ပုံတင္ေရးအဖြဲ႔နွင့္ ေဆြးေႏြး၍ အယူခံဝင္ခြင့္ရွိသည္။

အခန္း(၈) အသင္းအဖြဲ႔မ်ားအား အကာအကြယ္ေပးျခင္းနွင့္ အက်ိဳးခံစားခြင့္ ၂၀။     မွတ္ပုံတင္ထားသည့္ အသင္းအဖြဲ႔တစ္ရပ္ရပ္၏ ဥပေဒမ်ားနွင့္အညီ လႈပ္ရွားေဆာင္ရြက္မႈမ်ားအား သက္ဆိုင္ရာ၊ ဝန္ႀကီးဌာနမ်ားနွင့္ ေဒသဆိုင္ရာအုပ္ခ်ဳပ္ေရးအဖြဲ႔အစည္းမ်ားက ဥပေဒနွင့္အညီပူးေပါင္းပံ့ပိုး ကူညီ၍ အကာအကြယ္ေပးရမည္။ ၂၁။     မွတ္ပုံတင္ထားသည့္ ျပည္တြင္းအသင္းအဖြဲ႔တစ္ရပ္ရပ္သည္ နိဳင္ငံေတာ္မွေပးအပ္သည့္ ေထာက္ပံ့မႈမ်ား ကို လက္ခံရယူခြင့္ရွိသည္။ ၂၂။     မွတ္ပုံတင္ထားသည့္ျပည္တြင္းအသင္းအဖြဲ႔မ်ားသည္ နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔ တစ္ရပ္ရပ္ထံမွျဖစ္ေစ၊ ျပည္တြင္းအသင္းအဖြဲ႔တစ္ရပ္ရပ္ထံမွျဖစ္ေစ၊ ကူညီေထာက္ပံ့မႈျပဳလိုေသာ မည္သည့္ တစ္သီးပုဂၢလပုဂၢိဳလ္ထံမွျဖစ္ေစ  အေထာက္အပံ့ကို ဥပေဒနွင့္အညီ လက္ခံရယူခြင့္ ရွိသည္။ ၂၃။     မွတ္ပုံတင္ထားသည့္ အသင္းအဖြဲ႔တစ္ရပ္ရပ္သည္ တရားစြဲဆိုခြင့္၊ တရားစြဲဆိုခံပိုင္ခြင့္၊  ရန္ပုံေငြဖြင့္လွစ္ တည္ေထာင္ပိုင္ခြင့္၊ ဥပေဒနွင့္အညီ အလႉေငြေကာက္ခံနိဳင္ခြင့္၊ ဘဏ္စာရင္းဖြင့္လွစ္နိဳင္ခြင့္နွေင့္ ရႊ့ေျပာင္း နိုင္ေသာ ပစၥည္းနွင့္မေရႊ့ေျပာင္းနိုင္ေသာ ပစၥည္းပိုင္ဆိုင္ခြင္‌့့ ရွိသည္။ ၂၄။     မွတ္ပုံတင္ထားသည့္ အသင္းအဖြဲ႔တစ္ရပ္ရပ္သည္ မိမိအသင္းအဖြဲ႔၏ ကိုယ္ပိုင္တံဆိပ္၊ ကိုယ္ပိုင္ အမွတ္အသား၊  ကိုယ္ပိုင္ဝတ္စုံတို့ကို မူပိုင္ခြင့္ရွိသည္။

အခန္း (၉) အေထြေထြ ၂၅။     မည္သည့္နိုင္ငံေရးပါတီဝင္မဆို ဤဥပေဒအရဖြဲ႔စည္းေသာအသင္းအဖြဲ႔မ်ားတြင္ ဝင္ေရာက္လႈပ္ရွား ေဆာင္ရြက္ခြင့္ရွိသည္။ ၂၆။     မည္သည့္နိဳင္ငံ့ဝန္ထမ္း၊ ကုမၸဏီဝန္ထမ္းမဆို ဤဥပေဒအရဖြဲ႔စည္းေသာ အသင္းအဖြဲ႔မ်ားတြင္ ဝင္ေရာက္လႈပ္ရွား ေဆာင္ရြက္ခြင့္ရွိသည္။ ၂၇။     ျပည္တြင္းအသင္းအဖြဲ႔မ်ားနွင့္ နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ားသည္ မိတ္ဖက္ျပဳလုပ္၍ လုပ္ငန္းမ်ားေဆာင္ရြက္ရာတြင္ အျပန္အလွန္တာဝန္ယူမႈ၊ ရပိုင္ခြင့္နွင့္ အခန္းက႑မ်ား၌ ညီညြတ္မွ်တေသာ အေျခအေနျဖစ္ရန္ ေဆာင္ရြက္ရမည္။ ၂၈။ မွတ္ပုံတင္လက္မွတ္ ရရွိထားေသာအသင္း အဖြဲ႔မ်ားအေနျဖင့္ ခြင္‌့ျပဳစဉ္ကေဖာ္ျပခဲ့သည့္ ရည္ရြယ္ခ်က္နွင့္ လုပ္ငန္းစဉ္ကိုေျပာင္းလဲ၍ လုပ္ကိုင္ေဆာင္ရြက္လိုလွ်င္ျဖစ္ေစ၊ ေက်ာ္လြန္ ေဆာင္ရြက္လိုလွ်င္ျဖစ္ေစ သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔သို႔ တင္ျပရမည္။ ၂၉။     ျပည္တြင္းအသင္းအဖြဲ႔တစ္ဖြဲ႔သည္ ၿမိဳ့နယ္အဆင့္မွ ခရိုင္အဆင့္သို႔ျဖစ္ေစ၊ ခရိုင္အဆင့္မွတိုင္းေဒသႀကီး/ ျပည္နယ္အဆင့္သို႔ျဖစ္ေစ တိုးခ်ဲ့ဖြဲ႔စည္းလိုပါက ဤဥပေဒပါ ျပ႒ာန္းခ်က္မ်ားအတိုင္း သက္ဆိုင္ရာ မွတ္ပုံတင္ေရးအဖြဲ႔သို႔  တင္ျပေလွ်ာက္ထားေဆာင္ရြက္ရမည္။ ၃၀။     ျပည္တြင္းအသင္းအဖြဲ႔တစ္ဖြဲ႔သည္ နိဳင္ငံအတြင္း မည္သည့္ေဘးအနၲရာယ္မ်ိဳးကိုမဆို ႀကဳံေတြ႕ရသည့္ ေဒသသို႔  နယ္ေျမေက်ာ္လြန္  ေဆာင္ရြက္နိဳင္ခြင့္ရွိၿပီး ေဆာင္ရြက္မည့္သက္ဆိုင္ရာေဒသ၏ အုပ္ခ်ဳပ္ေရး အဖြဲ႔သို႔အေၾကာင္းၾကား၍  လႈပ္ရွားေဆာင္ရြက္ရမည္။ ၃၁။     မွတ္ပုံတင္ျခင္းမျပဳရေသးေသာ နိဳင္ငံတကာအသင္းအဖြဲ႔တစ္ခုသည္ နိဳင္ငံအတြင္းမည္သည့္ ေဘးအနၲရာယ္မ်ိဳးကိုမဆို ႀကဳံေတြ႕ေနသည့္ေဒသတြင္ လူမႈေရးလုပ္ငန္းမ်ားေဆာင္ရြက္ လိုပါက နိဳင္ငံတကာအစိုးရမဟုတ္ေသာ အသင္းအဖြဲ႔မ်ား မွတ္ပုံတင္ေရးအဖြဲ႔သို႔ ေလွ်ာက္ထားရမည္။ နိဳင္ငံတကာ အစိုးရမဟုတ္ေသာအသင္းအဖြဲ႔မ်ား  မွတ္ပုံတင္ေရးအဖြဲ႔က  ယာယီမွတ္ပုံတင္ခြင့္လက္မွတ္အား ေဆာလွ်င္ စြာ ထုတ္ေပးရမည္။ ၃၂။     အသင္းအဖြဲ႔တစ္ခုသည္ ဖ်က္သိမ္းျခင္း၊ အမည္ေျပာင္းလဲျခင္း၊ အသင္းလိပ္စာေျပာင္းလဲျခင္း ျပဳလိုပါက ဖြဲ႔စည္းမွတ္ပုံတင္ထားေသာ သက္ဆိုင္ရာမွတ္ပုံတင္ေရးအဖြဲ႔သို႔ (၇) ရက္အတြင္း အေၾကာင္းၾကား ရမည္။ ၃၃။     အဆင့္ဆင့္ေသာမွတ္ပုံတင္အဖြဲ႔မ်ားမွ အသင္းအဖြဲ႔ကိုယ္စားျပဳ ကိုယ္စားလွယ္မ်ားအေနျဖင့္ သတ္မွတ္ကာလ အမ်ားဆုံးလေပါင္း(၃၀)လွ်င္တစ္ႀကိမ္ အသင္းအဖြဲ႔မ်ား၏ အစီအစဉ္ျဖင့္ေရြးခ်ယ္ တင္ေျမွာက္ တာဝန္ေပးအပ္ရမည္။ ၃၄။     ဤဥပေဒပါ ျပ႒ာန္းခ်က္မ်ားကို အေကာင္အထည္ေဖာ္ေဆာင္ရြက္ရာတြင္ - (က)    ဝန္ႀကီးဌာနသည္ လိုအပ္ေသာနည္းဥပေဒမ်ား၊ စည္းမ်ဉ္းနွင့္စည္းကမ္းမ်ားကို အစိုးရအဖြဲ႔၏ သေဘာတူညီခ်က္ျဖင့္ ထုတ္ျပန္နိဳင္သည္။ (ခ)     ျပည္ေထာင္စုအဆင့္မွတ္ပုံတင္ေရးအဖြဲ႔သည္ လိုအပ္ေသာအမိန့္ေႀကာ္ျငာစာ၊ အမိန့္ ညႊန္ၾကားခ်က္နွင့္  လုပ္ထုံးလုပ္နည္းမ်ားကို  ထုတ္ျပန္နိုင္သည္။ ၃၅။ အသင္းအဖြဲ႔မ်ားဖြဲ႔စည္းျခင္းဆိုင္ရာ ဥပေဒ (နိုင္ငံေတာ္ၿငိမ္ဝပ္ပိျပားမႈ တည္ေဆာက္ေရး အဖြဲ႔၊ ဥပေဒအမွတ္ ၆/၈၈)အရထုတ္ျပန္ခဲ့ေသာ နည္းဥပေဒမ်ား၊ လုပ္ထုံးလုပ္နည္းမ်ား၊ အမိန့္နွင့္ညႊန္ၾကားခ်က္မ်ားသည္ ဤဥပေဒအရ ျပ႒ာန္းသည့္နည္းဥပေဒမ်ား၊ လုပ္ထုံးလုပ္နည္းမ်ား၊ အမိန့္နွင့္ညႊန္ၾကားခ်က္မ်ား ထုတ္ျပန္ ျခင္းမျပဳမီကာလအတြင္း  ဤဥပေဒနွင့္မဆန့္က်င္သေရြ့ ဆက္လက္က်င့္သုံးေဆာင္ရြက္ခြင့္ ရွိသည္။ ၃၆။     အသင္းအဖြဲ႔မ်ား ဖြဲ႔စည္းျခင္းဆိုင္ရာဥပေဒ (နိုင္ငံေတာ္ၿငိမ္ဝပ္ပိျပားမႈတည္ေဆာက္ေရးအဖြဲ႔၊ ဥပေဒအမွတ္ ၆/၈၈ )အား  ဤဥပေဒျဖင့္ရုပ္သိမ္းလိုက္သည္။ ၃၇။     ဤဥပေဒျဖင့္ ရုပ္သိမ္းလိုက္သည့္ အသင္းအဖြဲ႔မ်ားဖြဲ႔စည္းျခင္းဆိုင္ရာဥပေဒ (နိုင္ငံေတာ္ၿငိမ္ဝပ္ပိျပားမႈ တည္ေဆာက္ေရးအဖြဲ႔၊ ဥပေဒအမွတ္ ၆/၈၈ )အရ မွတ္ပုံတင္၍ ဖြဲ႔စည္းထားရွိေသာအသင္းအဖြဲ႔မ်ားသည္ ဤဥပေဒနွင့္အညီဖြဲ႔စည္းထားသည့္  အသင္းအဖြဲ႔မ်ားအျဖစ္မွတ္ယူရမည္။

 

အိမ့့့္သံစဥ္ ~

အသင္းအဖြဲ႔ မွတ္ပံုတင္ျခင္း ဥပေဒ အဂၤလိပ္ဘာသာျဖင့္ 

Chapter 1 Title and Definitions 1. This Law shall be called the Law relating to Forming of Organizations. 2. The following expressions in this Law shall have the following meanings-- (a) “State” means The Republic of the Union of Myanmar. (b) “The government” means the Union Government of the Republic of the Union of Myanmar. (c) 'International Non-Governmental Organization Registration Committee' means the registration committee which is formed and entrusted by the Union Government to undertake the registration of International non-governmental organization. (d) “State and Regional Level registration committee” means the registration committee which is formed and entrusted by state and region government to undertake the registration process at state and regional level. (e) “Nay Pyi Daw Council area level registration committee” means the registration committee which is formed and entrusted by Nay Pyi  Daw Council to undertake the registration process at Nay Pyi  Daw Council level. (f) “District level registration committee” means the registration committee which is formed and entrusted by self autonomous state and region, district administrative committee (or) district general administration department to undertake the registration process at district level. (g) “Township level registration committee” means the registration committee which is formed and entrusted by township level administration department to undertake the registration process at township level. (h) A local organization means a nonprofit association, in line with fundamental rights stated in constitution, which is working for the common interest or public interest, and is formed by two or more persons for the common objective or program. It also includes branch of an association. (e) “International non-governmental organization” means an organization that was registered in other country and plan to carry out any social activity in the country with the permission of the government. (g) “Registration certificate” means the acknowledgement certificate to international non-governmental organization and local non-governmental organization. (h) “Ministry” means Ministry of Home Affairs of the Union Government of the Republic of Union of Myanmar. (i) “Department” means the General Administration Department of Ministry of Home Affairs. (j) “Director General” means the Director General of General Administration Department. (k) “Director” means the Director assigned by General Administration Department to perform duties

Chapter II Objectives 3. Objectives of this law are as follows: (a) To follow the prescribed procedure for the registration of associations and registration of international non-governmental organization (b) To enable association to form and operate freely and systematically (c) To ensure that the activities of an organization are supportive to the benefits of the State and citizens  (d ) To get necessary support from respective ministries in line with law (e) To ensure the strengthening of the civil society organisations

Chapter III Formation of Registration Committee  and Responsibilities of Registration Committee 4. The government must form Registration Committee as below: (a) International non-governmental organization registration committee (b) State and Regional Level registration committee” (c ) Nay Pyi Daw Council areas level registration committee (d) District level registration committee (e)Township level registration committee 5. According to article (4) Responsibilities of Registration Committee are as follows: (a) Formation of International non-governmental organization registration committee, International non-governmental organization registration committee ust be formed with the following personnel: (1) Minister, Ministry of Home Affairs                                     Chairman (2) Deputy Minister of President Office                                   Member (3) Deputy Minister, Ministry of Foreign Affairs                         Member (4) Deputy Minister, National Planning and Economic Development                                                       Member  (5) Director General of General Administration Department                                                                       Secretary (b) State and Regional Level registration committee must be formed with the following personnel: (1) Social Welfare  Minister                                                   Chairman (2)  State or Region  Police officer                                         Member (3) 2 Representatives from state and region level organizations  Member (4) Director, State and Region General Administration Department          Secretary (c) Nay Pyi Daw Council areas level registration committee must be formed with people below: (1) Member of Nay Pyi Daw Council                                                 Chairman (2) District Police Officer, Myanmar police force                       Member (3) 2 Representatives from Nay Pyi Daw council area level organization                                                                                        Member (4) Director, Nay Pyi Daw General Administration department     Secretary (d) Formation of District level registration committee: committee of self-autonomous state (or) Committee of self-autonomous region (or) District administration department (or) regional general administrative department must form the District level registration committee with following personnel: (1) District Administrative officer, District General Administration Department                              Chairman (2) District Police Officer, Myanmar police force                       Member (3)  2 Representatives from district level Local organization                 Member (4) Administrative officer from general Administration department                                                                                                          Secretary (e) Formation of Township Level registration committee: Township general Manager, township level general administration department must form the Township Level registration committee with following personnel: (1) Township general Manager, Township level General Administration Department                                        Chairman (2) Township Police Officer, Myanmar Police force                              Member (3) 2 representatives from township level organization              Member (4) Administrative officer from general Administration department                                                                                                          Secretary 6 Responsibilities of Registration Committee are as follows: (a ) to make decision on  registration of organizations (c) to issue registration  certificate and renew the certificate according to the procedure (c ) (e) to give necessary assistance to follow the registration procedure under this law (d) to give instruction to render necessary assistance for cooperation between an organization and respective ministries (e) International non-governmental organization registration committee’s responsibility is to give registration and renew it to international non-governmental organizations

Chapter IV Registration of Local Organizations 7 The chairperson, Secretary or Responsible person of an organization shall submit the application to the respective registration authorities according to the procedures to get registration certificate as per their free will. (a) Organization name (b) Organization address and location (c ) organization starting date (d) Objectives (e) Activities (f) Number of committee members (g) Number of Members (h) Organization’s fund and assets (i) Activities being implemented (j) Organization’s structure and article of association (k) Other documents (l) Application date 8  The applicant organization according to article 7 will be  issued the temporary registration certificate within 7 days, and will be examined with prescribed criteria, (a)  Registration certificate will be issued in following days if the formation is permitted (1) National Level Registration Committee                              60 days (2) State and Regional Level registration committee                            60 days (3)  Nay Pyi Daw Council level registration committee               30 days (4)  District level registration committee                                 30 days (b) An organization whose registration has been approved must pay the registration fee. (c ) The committee shall notify in writing to the association or organization whose formation has not be been approved giving adequate reason in following days: (1) National Level Registration Committee                              30 days (2) State and Regional Level registration committee                            30 days (3)  Nay Pyi Daw Council level registration committee               30 days (4)  District level registration committee                                 30 days (d) An organization whose registration has not been approved shall receive the reasons in the written document and also has the right to appeal. 9 An organization registered in one region can work in other States and Divisions with the approval from the respective registration authority. Registration fee is 30’000 kyats. 10 An organization registerd in Nay Pyi Daw council area can work in the whole Division with the approval from the Nay Pyi Daw council area registration authority. Registration fee is 30’000 kyats. 11. An organization registered in self-autonomous region can work in the whole Division/State with the approval from the respective registration authority. Registration fee is 10’000 kyats. 12. An organization who registered in township level registration committee or self autonomous region or state or in one district can work in the area with the approval from the respective registration authority. No registration fee is needed.

Chapter V Registration of International Non-governmental Organizations 14. The Responsible person of an international non-governmental organization shall submit the application to  international non-governmental organization registration committee according to the procedures to get registration certificate. (a) Organization Name (b) Organization’s head name (c ) Responsible person’s name (d) Organization address and location (e) Head office (f) Activities in Myanmar (g) Related Ministries (h) Project information (i) Number of Committee members (j) Location of branch office and address (k) Responsible person for branch office (l) Application date 14. The applicant organization according to article 7 will be issued the temporary registration certificate within 7 days, and will be examined with prescribed criteria, (a)  Registration certificate will be issued within ninety days starting from the date of application if the formation is permitted (b)An organization whose registration has been approved must pay the registration fee. Registration fees is (100,000) Kyats. (c) The committee shall notify in writing to the association or organization whose registration has not be been approved giving adequate reason within thirty days. (d) An organization whose registration has not been approved has the right to be given adequate reason and has the right to appeal.

Chapter VI Organizations That Do Not Require To Apply For Registration 15. the following organizations do not require to apply for registration; (a) Organizations that purse religious and economic activities only: (b) Organization formed under the Political Parties Registration Law with the Union Elections Commission: (c) Organization registered under any existing law

Chapter VI Renewal of Registration Certificate 16. All registered shall submit annual report to respective registration committee. The committee shall consider the organization who submits annual report as functioning organization. Registration certificate shall be renewed after five years. No registration fee is needed for renewal. 17. All registered organizations who fail to submit annual report for 5 consecutive years shall be considered as not functioning. If this organization wants to reactivate, new registration certificate application process shall be pursued. 18. A local organization that is not permit to be renewed shall not function or continue to exist over Ninety (90) days starting from the date of receiving noticifation letter from respective registration committee still have the +right to appeal for renewal after negotiation with the respective registration committee making necessary changes. 19. An international non-governmental organization that is not permit to be renewed shall not function or continue to exist over one hundred and eighty days (180) starting from the date of receiving notification letter from respective registration committee still have the right to appeal for renewal after negotiation with the respective registration committee making necessary changes.

Chapter VII Protection and Benefits of the Association 20. Any legitimate act of registered organization under this law shall have the corporation and protection from related regional administration department. 21 . Registered organization under this law shall have the right to receive the support from the State. 22. Registered organization under this law shall have the right to accept support from any registered international non-government organization, local organization or any individual who wants to support. 23. Registered organization under this law shall have the right to file a law suit, do fund raising activities, receive funding and open a bank account and own properties or assets. 24. Registered organization under this law shall have the right to have own logo, trademark and uniform.

Chapter VIII General 25. The member of any political party may participate in organization formed under this law. 26. Any government staffs and companies employees may participate in organization formed under this law. 27. Accountability and rights of both local organizations and international non-governmental organizations shall be made equitable while collaborating. 28. Any registered organization under this law shall inform registration committee when they wish changes the aim and type of implementation from the registered one. 29. Under this law, local organizations shall inform respective Registration Union when they wish to expand their activities from township to district, district to state/region and state/region to the whole country. 30. In case of any emergency, any registered local organization can start humanitarian emergency activities after informing the respective local administrative office. 31. In case of any emergency, temporary registration will be issued to any international non-governmental organization by international non-governmental organization registration committee.  International non-governmental organization registration committee has to issues the temporary registration certificate as soon as possible. 32. Organization disbanding, changing name or changing physical address must inform the respective registration committee within seven days 33.  Representatives from local organization who participate in respective registration committee must be reelected in every 30 months in maximum. 34.  While implementing of the prescribed procedures of this law, (a) The Ministry may enact necessary bylaws and rules and regulations with the approval of the government. (b) The National level registration Committee may make necessary rules, orders, directives and procedures. 35. Bylaws, rules, orders, directives and procedures enacted under associational law (Law no. 6/88 under State Law and Order Restoration Council) continue to be valid, if not contrary to this law, until Bylaws, rules, orders, directives and procedures are enacted under this law 36. Associational law (Law no. 6/88 under State Law and Order Restoration Council) will become void by this law. 37 . All current registered organization under associational law (Law no. 6/88 under State Law and Order Restoration Council) which is void by this law are assumed as registered organizations under this law.
